By accessing or using iceaxe.tv (the “Site”) and/or any services, content or trips offered through the Site (the “Services”), you (the “User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Site or Services.
1. Description of Services
Ice Axe Expeditions provides information about, and access to, adventure travel and expedition trips (e.g. skiing, sailing, outdoor expeditions), as well as related content (descriptions, images, videos, resources) on the Site. The Site also may link to third-party sites, partner services, or external resources.
2. Eligibility & User Obligations
By using the Site or Services, you represent that you are of legal age (or, if underage, have permission from a parent or guardian) and that you can form a binding contract under applicable law. You agree to use the Site and Services only for lawful purposes and in compliance with all applicable laws and regulations. You will not use the Site to post, upload, transmit or otherwise make available content that is illegal, harmful, infringing, defamatory, obscene or otherwise objectionable. You are responsible for maintaining the confidentiality of any account credentials (if applicable) and for all activity under your account.
3. Intellectual Property & Content Use
All content on the Site — including text, images, videos, logos, graphics, course/trip descriptions, and other media (“Content”) — is the exclusive property of Ice Axe Expeditions or its licensors, and is protected by copyright, trademark, and other intellectual property laws. Users may view and use the Content only for personal, non-commercial purposes and only as intended by the Site. Any other use (reproducing, modifying, distributing, publishing, embedding, selling, licensing, or otherwise exploiting the Content) is prohibited without express prior written permission. If the Site allows user-generated content (e.g. comments, reviews, photos), you grant Ice Axe Expeditions a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, publicly display, and perform that content, in any media.

The Site may contain links to third-party websites, services, or resources. These links are provided for convenience only. Ice Axe Expeditions does not endorse, guarantee, or assume responsibility for the content, accuracy, privacy practices or policies of any third-party sites. Use of any linked site is at your own risk.
5. Disclaimers; Limitation of Liability
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Ice Axe Expeditions does not guarantee that the Site will be error-free, secure, or uninterrupted, that defects will be corrected, or that the Site is free of viruses or other harmful components. Under no circumstances shall Ice Axe Expeditions (or its officers, directors, employees, agents or licensors) be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use (or inability to use) the Site or Services — including but not limited to loss of profits, loss of data, loss of opportunities, or personal injury — even if Ice Axe Expeditions has been advised of the possibility of such damages.
6. Termination & Account Suspension
Ice Axe Expeditions reserves the right, in its sole discretion, to suspend or terminate your access to the Site or Services (or any portion thereof), at any time and for any reason (including violation of these Terms), without prior notice. Upon termination, your right to use the Site and Services will immediately cease.
7. Modifications to Terms
Ice Axe Expeditions may modify these Terms at any time. The revised Terms will be posted on the Site, and the “Effective Date” will be updated. Continued use of the Site or Services after such changes constitutes your acceptance of the modified Terms.
8. Governing Law & Dispute Resolution
These Terms and your use of the Site and Services shall be governed by and construed in accordance with the laws of the State of California (or the state in which Ice Axe Expeditions is legally incorporated), without regard to its conflict of law provisions. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the state or federal courts located in California.
9. Privacy & Data
Use of the Site may involve processing personal data (via cookies, contact forms, trip bookings, newsletter or updates subscription, etc.). Your personal data will be handled in accordance with our Privacy Policy, incorporated herein by reference.
10. Severability & Entire Agreement
If any provision of these Terms is invalid or unenforceable under applicable law, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and Ice Axe Expeditions regarding your use of the Site and Services, superseding any prior agreements.
11. Changes to the Terms of Service
Ice Axe Expeditions reserves the right to modify or update these Terms of Service at any time. The “Last updated” date at the top will reflect when changes were made. Continued use of the Site or Services after changes are posted constitutes your acceptance of the revised Terms of Service. You are encouraged to periodically review the Terms of Service to stay informed of your rights and obligations.
12. Booking, Payment & Refund / Cancellation Policy
If you book an Expedition or other paid Service via the Site, the terms governing payment, cancellation, refunds, changes, and liability will be provided in the relevant booking agreement or confirmation. By booking, you agree to abide by those terms. (If no payment or booking is involved, this section may not apply.)
13. Risk, Disclaimers & Limitation of Liability / Warranty
No Warranty. The Site and the Services are provided “as is,” without warranties of any kind, express or implied. Ice Axe Expeditions does not guarantee availability, accuracy, completeness or fitness of any information, itinerary, description, or content. Assumption of Risk. You acknowledge that participation in backcountry skiing, polar expeditions, wilderness travel, and adventure activities involves inherent risks, including, but not limited to, harsh weather, terrain dangers, wildlife, isolation, injury, and travel adversity. You assume all risks associated with participation. Limitation of Liability. To the fullest extent permitted by law, Ice Axe Expeditions shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of the Site or Services, including but not limited to injury, loss of property, travel disruptions, or other damages, even if Ice Axe Expeditions has been advised of the possibility of such damages.
